Samsung X file incident is emerging once more. This is the incident where presidential nominee, prosecutor and total directional Samsung lobby took place. The people who were involved in the give and take of the black money were found acquitted. Actually, the reporter who publicized this event and NoHye Chan congressmen remained ex-convict. 이러한 결론이 나온 데는 기소독점주의와 기소편의주의라는 '제왕적 검사제도'가 밑바탕에 있다. 형사소송법 제246조는 검사만이 공소권을 행사할 수 있도록 하고 있다. 공소권 행사를 한정하고 통일시키기 위해 '기소권'을 검사로 한정했다. 하지만 이는 결국 우리나라에서 '유권불기소 무권기소'라는 결과를 낳았다.
